Three Virginia deputies cleared after fatally shooting wanted suspect Dustin Griffin who wounded officer: prosecutors

Three Augusta County sheriff’s deputies have been cleared of wrongdoing following a fatal December 2025 shooting.

The encounter left 42-year-old Dustin Griffin dead and one deputy wounded.

On Dec. 17, three deputies assigned to the sheriff’s narcotics unit attempted to arrest Griffin.

The incident took place on Parkersburg Turnpike.

Around 8:40 p.m., the deputies moved in to serve Griffin with six felony warrants.

But gunfire erupted during the arrest attempt.

Griffin allegedly shot an officer as the narcotics unit approached.

One deputy was struck in the arm.

That deputy suffered non-life-threatening injuries.

The other two deputies returned fire at the scene.

Griffin was killed in the exchange.

Then the Virginia State Police stepped in to conduct an independent investigation into the shooting on Parkersburg Turnpike.

State police turned their investigative findings over to the Augusta County Commonwealth’s Attorney’s Office.

Prosecutors then reviewed the evidence surrounding the narcotics deputies’ actions.

After reviewing the investigation, prosecutors concluded the deputies were legally justified in using deadly force.

The prosecutor’s office determined that the deputies’ actions were justified under the law.

The formal review into the December shooting is now complete.

And no charges will be filed against the three deputies.
