A 37-year-old father was booked for battery after a Thanksgiving custody handoff turned into a violent driveway fistfight, police said.

Gabriel Aubry, 37, is the ex-partner of Halle Berry and the father of their daughter, Nahla.
Aubry pulled up to Berry’s Los Angeles home on Thanksgiving morning in 2012 the way he had many times before, according to reports.
The father arrived to collect their daughter Nahla under their custody arrangement, the account stated.
Waiting for him in the driveway was Berry’s fiancé at the time, French actor Olivier Martinez. Within minutes, the custody handoff turned into a fistfight neither man would walk away from cleanly.
Investigators who looked into the brawl concluded that Aubry allegedly swung first, police said.
That punch allegedly missed Martinez’s head and struck his shoulder instead, according to investigators.
Aubry was the combatant who ultimately ended up on the ground, police said.
Martinez allegedly answered the swing with three punches directly to Aubry’s head, investigators reported.
Paramedics were dispatched to the residence to treat Aubry’s injuries, according to reports.
Aubry suffered two black eyes, bruised ribs, and a serious head injury from the exchange, according to reports. One eye was swollen almost completely shut, leaving him in a hospital gown instead of a jacket.
Martinez left the fight with a sore neck and what doctors initially thought was a broken hand. Those injuries never made him look like the loser of the two, the account noted.

Aubry was the one booked for misdemeanor battery, police said. He was held on $20,000 bail, even though his was the face that needed a hospital bed.
Aubry offered an entirely different version of the morning in a request for a restraining order filed days later.
Martinez allegedly came down the stairs and knocked him to the ground unprovoked, Aubry stated in the court documents.
The actor then allegedly grabbed Aubry’s head and slammed it into the concrete driveway, the filing stated.
Martinez screamed that they were moving to Paris and told Aubry he had better move there too, according to the filing.
The actor allegedly threatened to kill the father if he did not move to France, Aubry claimed in the court papers.
Aubry claimed Martinez leaned in close once the physical fight had ended, according to the documents.
“You’re going to tell them that you’re the one who attacked me, or I’m going to kill you,” Martinez allegedly told him, according to Aubry’s filing.
The restraining order lasted about a week before Aubry dropped the petition, records show.
The two sides quietly settled the matter out of court, according to reports.
Prosecutors never filed a single charge against either man, records show. Aubry was called into a city attorney’s office instead of a courtroom, according to reports.
Officials warned Aubry that any further trouble would be handled differently next time. Neither account of the altercation was ever tested in a courtroom.
Martinez married Berry the following year, and the couple divorced two years after that.
