Explicit video sparks court petition to question more minors in KJ Biermann sex case: prosecutors

A Georgia teenager faces a state petition seeking court-ordered forensic interviews of minor children in an ongoing sex-crimes prosecution, according to court documents.

The defendant is 15-year-old Kroy “KJ” Biermann Jr., the son of estranged couple Kim Zolciak and Kroy Biermann, who was arrested in Alpharetta, Georgia.

Lawyers representing the State of Georgia filed the new motion on Thursday, September 17, court records show.

The filing formally asks the court to require “forensic interviews” with unidentified minors, according to documents obtained by Us.

TMZ was first to report the state’s request, according to records.

“The state will proffer a good faith basis for concern regarding additional minors who require forensic interviews related to this case,” the docs read.

“To the extent the court must consider video evidence and receive a proffer by counsel related to potential victims, the state requests [the] same be done in camera or in a closed courtroom, with counsel for defendant present,” prosecutors wrote. “The video evidence is explicit in nature and should be reviewed and considered under seal.”

The 15-year-old was arrested in Alpharetta in August following an alleged incident with an unidentified minor victim earlier this year, police said.

At the time of that initial custody, Biermann was booked for aggravated sexual assault and aggravated sodomy, authorities said.

Following his arrest, video footage was found of the youth allegedly engaging in sexual behavior with an underage relative, prosecutors claimed in court.

The state also claimed in court that there were allegedly “multiple encounters” where the teenager used “predatory [and] derogatory” language toward the unidentified victim.

“The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” his lawyer Jason Sheffield told TMZ in a statement, addressing the accusations. “The matter arose from inappropriate, crude behavior involving two middle-schoolers.”

The defendant was also indicted earlier this month on seven additional felony counts, according to court documents.

The indictment charges him with aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under the age of 16, records show.

He has not been arrested for the remaining charges in the indictment, records show.

Biermann was held at an Atlanta-area juvenile detention center following his custody, records show. He was granted $200,000 bail on September 11, according to court documents.

Per the terms of his bond, the youth is required to wear an electronic ankle monitor under 24-hour house arrest, filings state.

The conditions of release also forbid him from having any access to a cell phone or social media, according to records.

Attorneys for the defendant have since requested to transfer the case to juvenile court, which would prevent him from being tried as an adult, records show.

The defense team also moved to close all hearings to “protect juvenile identities” and records, court documents state.

A judge ruled on Thursday to restrict media recording and photography during proceedings in the case, records show.

“To that end, any such records shall be filed under seal and any such exhibits admitted at the bond hearing for the court’s consideration will conform to the terms of this order, accordingly,” the ruling states.

Us reached out to the teenager’s lawyer for comment, the outlet reported.

Biermann has categorically denied the accusations, according to records. He has yet to enter a plea, court documents state.

The defendant will now be subject to pretrial supervision ahead of his arraignment in October, according to court documents.
